These Terms of Use ("Terms") govern your access to and use of the SwipeStay website and mobile application (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
What SwipeStay does
SwipeStay helps you discover hotels and other stays and connects you to third-party booking partners to complete a reservation. SwipeStay is not a travel agent and is not the seller of any accommodation. All bookings, payments, cancellations and the accommodation itself are provided by the relevant third-party partner and are subject to that partner's terms and conditions.
Prices and availability
Prices, availability, ratings and other listing information are provided by our partners and may be cached or delayed. They can change at any time and may contain errors. The price and terms that apply to your booking are the ones shown by the booking partner at the moment you complete your reservation — not necessarily the figure displayed in SwipeStay.
Affiliate relationship
SwipeStay may earn a commission when you book through a link in the Services, at no additional cost to you. This does not affect the price you pay or the order in which stays are shown.
Acceptable use
You agree not to misuse the Services. In particular, you will not:
- use the Services for any unlawful purpose or in breach of any applicable law;
- attempt to scrape, copy, resell or systematically extract content or data from the Services;
- interfere with, disrupt, or attempt to gain unauthorised access to the Services or their underlying systems;
- misrepresent your affiliation with SwipeStay or any third party.
Intellectual property
The SwipeStay name, logo, and the content we create are owned by SwipeStay or its licensors. Hotel content, photography and reviews shown in the Services belong to their respective owners and partners and are used in accordance with the applicable program terms.
Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or that any listing information is accurate, complete or current.
Limitation of liability
To the fullest extent permitted by law, SwipeStay will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising out of your use of the Services or any booking made with a third-party partner. Nothing in these Terms excludes any liability that cannot be excluded under applicable law, including your statutory consumer rights.
Third-party links
The Services contain links to third-party websites and services that we do not control. We are not responsible for their content, products, or practices, and your use of them is governed by their own terms and privacy policies.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
